1. Acceptance of Terms
By creating an account, accessing, or using Roostrr (the "Service"), you agree to these Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the Service.
We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by updating the date at the top of these Terms and, in some cases, providing additional notice via email or dashboard notifications.
2. Account & Usage Rights
- Eligibility: You must be at least 18 years old to use the Service.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
- License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.
3. AI Services & Disclaimers
Roostrr utilizes advanced artificial intelligence to provide voice and text capabilities. By using the Service, you acknowledge the following:
Accuracy: AI models may occasionally generate incorrect, misleading, or offensive information ("hallucinations"). You are responsible for evaluating the accuracy of any output generated by the Service.
No Professional Advice: The Service is not a substitute for professional legal, medical, or financial advice.
Availability: We strive for high uptime, but the Service relies on complex AI infrastructure which may experience occasional outages.
4. Telephony & Voice Services
Roostrr provides telephony capabilities using Voice over IP (VoIP) technology. Specific terms apply to these features:
- No Emergency Services: The Service is not intended to support or carry emergency calls to any type of hospitals, law enforcement agencies, medical care unit, or any other kind of services that connect a user to an emergency services personnel (e.g., 911, 112, 999).
- Call Recording Compliance: The Service includes features that allow you to record conversations. You are solely responsible for complying with all applicable laws regarding call recording, including obtaining necessary consent from all parties to the conversation in jurisdictions where required.
- Caller ID & Spoofing: You agree to use valid Caller ID data. Spoofing numbers or misrepresenting your identity is strictly prohibited and grounds for immediate termination.
5. Prohibited Conduct
You agree not to use the Service to:
- Generate content that is illegal, harmful, threatening, or sexually explicit.
- Impersonate any person or entity without their consent (e.g., non-consensual voice cloning).
- Engage in harassment, bullying, or hate speech.
- Attempt to reverse engineer, decompile, or discover the source code or underlying components of Roostrr.
- Violate telemarketing laws (such as the TCPA in the US or local equivalents) by making unsolicited calls without proper consent.
- Use the Service for high-volume automated spam calling (robocalling) or fraudulent activities.
6. Fees & Payments
Certain features of the Service are subject to fees. We utilize secure third-party payment processors for billing.
- Subscription Terms: SaaS Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Telephony Usage Billing: Voice services are billed on a usage basis (per second or per minute) as outlined in your plan. You agree to pay for all calls initiated or received by your account, regardless of who placed the call.
- Refunds: Refunds are handled on a case-by-case basis. Please contact support if you believe you have been billed incorrectly.
7. Limitation of Liability
To the maximum extent permitted by law, Roostrr and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service; or
- Unauthorized access, use, or alteration of your transmissions or content.
